1. Seller and scope

1.1 The seller of the gift card is the restaurant named in the legal notice (Impressum), hereafter the Restaurant. The order process and the payment connection are operated technically by the Bitelery platform; Bitelery does not become a party to the contract.

1.2 These terms apply to gift cards bought through this website and, where applicable by their content, to gift cards bought directly at the restaurant. Section 7 (right of withdrawal) does not apply to a purchase concluded at the restaurant; see there.

2. Subject matter

2.1 The gift card is a balance in euros that can only be redeemed against the Restaurant's own services. It is not tied to a particular item.

2.2 The gift card is issued as a code. Whoever presents the code can redeem the balance. Treat the code like cash and keep it safe.

2.3 The gift card is transferable: it may be given away or passed on. Whoever presents the code is entitled to redeem it; no check of entitlement is made.

3. Conclusion of contract and payment

3.1 By clicking the button labelled Zahlungspflichtig bestellen you place a binding order. The contract comes about when the gift card code is provided.

3.2 The amount shown is the price payable. No further costs arise.

3.3 The gift card is a multi-purpose voucher within the meaning of section 3 (15) of the German VAT Act (UStG) because it is not tied to a particular service. VAT therefore does not arise on the purchase of the voucher but only on its redemption, at the rate applicable to the service actually received. No VAT is shown when the voucher is bought.

4. Provision

4.1 The code is sent to the email address given during the order immediately after payment.

4.2 Physical gift cards are not shipped.

4.3 Gift cards can also be bought directly at the restaurant. The code is then written onto a paper voucher and handed over. A gift card bought this way is identical in substance to one bought through this website and is redeemed the same way.

5. Redemption

5.1 Redemption takes place on site at the restaurant.

5.2 Partial redemption is possible; the remaining balance stays on the same code.

5.3 The balance is not paid out in cash.

5.4 No further restrictions apply. In particular the gift card is valid on all opening days and for everything the restaurant offers, it can be combined with the lunch menu and with other offers or promotions, and there is no minimum order value.

5.5 If the code is lost it cannot be replaced. We therefore recommend keeping the gift card as safe as cash (section 2.2).

6. Validity

6.1 The gift card carries no printed expiry date. The statutory limitation period of three years applies; it starts at the end of the year in which the gift card was bought (sections 195, 199 (1) of the German Civil Code, BGB).

7. Right of withdrawal

7.1 For a purchase concluded through this website (a distance contract) consumers have a right of withdrawal; the details are set out in the withdrawal policy.

7.2 Gift cards bought directly at the restaurant carry no statutory right of withdrawal, because the contract is not concluded at a distance.

8. Final provisions

8.1 German law applies.

8.2 We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body.

9. Information on the conclusion of the contract

9.1 Technical steps: on the gift card page you choose an amount, give your email address, confirm these terms and the withdrawal policy, and click Zahlungspflichtig bestellen. That places your order bindingly. You are then forwarded to our payment service provider Stripe. After successful payment you receive the gift card code by email.

9.2 Input errors: before you submit the order you can change your entries, that is the amount and the email address, at any time on the gift card page, or leave the page without an order coming about.

9.3 Storage of the contract text: we do not store a separate contract document, and it is not retrievable through this website after the order. You can call up and save these terms and the withdrawal policy here at any time; in addition you receive both together with your order confirmation by email.

9.4 Contract language: the contract may be concluded in German, English or Turkish. The English and Turkish versions of these terms and of the withdrawal policy are convenience translations; the German version governs.

9.5 Codes of conduct: we have not submitted to any particular codes of conduct.
